You might want to check with a NFCC credit counseling service: http://www. nfcc. org/. These are legit, non-profit companies that offer debt management programs for a nominal fee. They do not negotiate settlements. They negotiate lower interest and payments so that you can pay off your debt.

This works best for credit card debt and may not be helpful with that mortgage or other defaulted debts. They do free counseling and can look at your finances and offer advice on how to proceed, including if you need to file bankruptcy. If you do opt to file bankruptcy, you will need an attorney.

Normally 401k and other retirement accounts are exempt from bankruptcy.

Be very careful about debt settlement companies. Most are scams that only take your money.

A consumer credit counseling agency cannot help you with a creditor that is suing you.

Generally speaking, a 401k will be protected through a bankruptcy proceeding.

Nearly all consumer bankruptcy attorneys offer free consultations. Take advantage of this to meet with one and get advice based on all of the details of your particular situation. You can find a referral at NACBA. org (National Association of Consumer Bankruptcy Attorneys).
