get a lawyer,or maybe all change ur phone numbers and be very careful who u give the numbers out to! if she doesnt owe the debt,but is being hassled for it,look intothe possibility that someone has stolen her identity and is racking up debt in her name-go to her bank,they can look into this for u!good luck,sounds to me that is what happened !!!!
Are you sure its them?? It might be someone trying to make money , you know all the thieves out there so becareful.
When they call have her take their name and write down the time they called. At that point she should tell them to Cease and Desit all calls. Any collection agency according to FDCPA law must follow this. Look online at FDCPA laws and you will learn a lot. If your mother in law has this much debt, think about hiring an aty and just filing bankruptcy, it would probably be best then all calls have to stop. Good Luck!
DO NOT Call them, that does nothing for you(or your Mother In Law).
If your MIL is still capable have her write a Debt Validation letter to the company. If not you can get power of attorney and act on her behalf. In the letter also state that they are to no longer contact her or anybody else in reference to the account by phone. Send it by certified mail with return receipt.
Until they validate the debt they can not take any further action against her. If they call her or anyone else about the debt you can take them to court for violations of the Fair Debt Collection Practices Act.
If you are sure the debt is not hers, send them a certified, return receipt letter requesting that as the debt is not hers, they cease and desist all contact with her or any family member. In accordance with the FCRA, they have to stop all contact.
Telling them on the phone is not the same. You need a papertrail to proof when they were notified.
It is likely the names and titles are fictitious, it is a well known tactic to change names and titles frequently so the person you talked to last doesn’t work there anymore. This kind of harassment is a violation of the credit collection laws. My advice send the company a registered letter telling them not to call any more. If they do contact an attorney and sue them.
